Terms of service
Version 0.1 · Not yet in effect
Draft, pending legal review. This text is not in effect.
About these terms
These terms are an agreement between you and [PLACEHOLDER: legal entity name], trading as Ocupop, of [PLACEHOLDER: registered address] (“we”, “us”). They apply when you take Where You Stand, join a room of Doomers, Gloomers, Bloomers & Zoomers, or host one. By using the service you agree to them. Our privacy policy explains what we do with your information.
What the service is
Where You Stand is a diagnostic. It asks about you, your organization and the decisions you can actually make, and ends in a job: one of EXPLORE, PROVE, PROTECT, TRANSLATE, REDESIGN, INSTITUTIONALIZE or DELIMIT. DELIMIT, drawing a line around where AI should not go, is as valid a result as any other. The service does not assume that using more AI is better.
Your result is a reading of what you told us at one point in time, not a verdict on you or your work. It is not professional, legal, financial, employment or medical advice. Decide what to do with it as you would with any other input.
We may show you offers that follow from your result. They never decide your job, and you are free to ignore them.
Who can use it
You must be at least 16, or [PLACEHOLDER: a higher minimum age where the law requires one], to use the service. If you take it on behalf of an organization, or host a room for one, you confirm that you are allowed to do so.
Using it fairly
Please answer as yourself. Do not scrape the service or copy its questions in bulk, overload it or get around its limits, interfere with a room or with other people’s answers, try to reach information that is not yours, pretend to be a host or to speak for us, or use it to break the law.
We may limit, pause or end access for anyone who does, without notice where we need to protect the service or other people.
Hosting a room
If you create or run a room, you and the organizer you run it for are responsible for how it is presented to the people in it: what you tell them before they join, and that the room is a fit for the event.
Creating a room needs an operator key, and running it needs the room’s host key, which is shown to you once. Both keys are yours to keep safe. Anyone who has a host key can drive that room and download its export. If a key is lost or shared, tell us and stop using that room.
A room’s export carries answers and positions under ids made for that room, never names. Use it only to discuss the room’s results, and do not try to identify the people in it. Mark a practice run as a rehearsal, so that its answers stay out of the data.
Tell the room what the consent screen tells them: answers are anonymous and seen only all together, nobody’s name is on the screen, and saving a result with an email is their own choice, offered on the phone only after their job is revealed.
Who owns what
The service, its questions, its results, its design and its names are ours or our licensors’, and are protected by law. You may keep, print and share your own result.
Your answers are yours. You give us a non-exclusive, worldwide, royalty-free licence to store and process them to run the service for you, and to use them, without anything that identifies you, as anonymous research data to test and improve the questions and to report how people answer. That licence lasts as long as we hold the answers under the privacy policy.
If you send us feedback or ideas, we may use them without owing you anything.
Availability
We work to keep the service running, but we provide it as it is and as available, without warranties of any kind, to the extent the law allows. It may change, pause or stop, and a room can be interrupted by a network or a venue’s Wi-Fi. Keep your own copy of anything you need.
Limits on our liability
[PLACEHOLDER: limitation of liability, as counsel sets it, including what cannot be limited under the law that applies.]
Ending use
You can stop using the service at any time, and delete everything we hold under your email from the Your data page. We may end or suspend access under these terms. The parts of these terms that by their nature should continue, such as ownership and the limits on liability, continue after that.
Governing law
These terms are governed by [PLACEHOLDER: governing law], and disputes go to [PLACEHOLDER: courts or venue], except where the law where you live gives you the right to bring them elsewhere.
Contact
Write to us at [PLACEHOLDER: contact email], or by post at [PLACEHOLDER: registered address].
Changes to these terms
When we change these terms, we publish a new version with a new version number and date. If you keep using the service after that, the new version applies; it does not reach back to what happened before.
